On September 4, 2010 at approximately 2:30 PM, I was visiting the Price Chopper store located on Erie Blvd., Syracuse NY. In good faith, I parked my car in the parking lot on the west side of the stores north (main) entrance. After completing my purchases at approximately 2:45, I returned to the parking lot and noticed evident damage to the driver's side of my 2009 Mazda 6 S GT, including forceful removal of the side mirror, several scratches to the painted surfaces and damage to the left front wheel. I was brought to the attention of a gentleman parked directly in front of my vehicle, who creditably witnessed the events causing the before mentioned damage to my vehicle. The witness informed me that a shopping cart, that was one of several, staged adjacent to the building near the front entrance had been blown by the strong winds occurring that day, rolled down the parking lot and at high speed and collided with my vehicle causing the damage. I immediately notified the acting store manager, Mr. Frank Bowman, who examined the vehicle and took relevant information about the incident. Mr. Bowman informed me that he would forward the information to the corporate offices of Price Chopper and someone from Price Chopper's claims department would contact me in a few days. I remained in the Price Chopper parking lot for several minutes, taking pictures of the damage and the location from where the shopping cart that damaged my property was staged. During this time, I witnessed one of the Price Chopper's attendants removing stray carts from the lot, place several more in the staging location adjacent to the building near the front entrance (where the cart that damaged my property had originated). It was a very windy day and any reasonable attempt to keep carts from damaging property would certainly include securing all carts inside the large main entrance, out of the wind. Failure to do so is clearly negligence by Price Chopper's employee(s).

Since September 7th, I have made several attempts to contact Price Chopper's claims department without success. On September 10th, I contacted a customer service representative at the Erie Blvd., Syracuse store who gave me the contact information for Preferred Adjustment Company Inc, and informed me that they would handle the claim". I Left five phone messages for Mr/. Edward Rufer, the general adjuster, between September 7th and September 16th, with never a return call?. In fact, nobody ever contact me directly to take a statement or verify the facts of this incident, nor has the witness apparently been contacted|. On September 16th, 2010, I received a letter from Preferred Adjustment Company denying my claim?. The facts stated in their letter do not accurately reflect the facts of this incident, specifically, the shopping cart that damaged my property did not directly originate from the parking lot, but from the staging area outside the store's main entrance and that is was most likely placed there by a store employee;. It is clear from the unresponsiveness of Preferred Adjustment Company and Price Chopper and that no statements were ever taken or verified from myself or the witness, Price Chopper is not interested in taking responsibility for their clear negligence and that the letter sent on their behalf by Preferred Adjustment Company is merely a form letter designed to discourage all, even legitimate, claims". I am seeking the advice of an attorney to further pursue this matter

Given the attitude of Price Chopper regarding claims, I will no longer patronize Price Chopper stores and will tell everybody that will listen how badly Price Chopped has treated me in this matter.. The damage to my vehicle is not extensive, the estimate for repairs is reasonable and Price Chopper's decision to naively refuse my claim is yet another example of a large corporations apathy towards their customer base (community).

Welcome to the real world. Why don't you sue the wind for the cart? you think your sad little story will stop anybody from shopping at Prime Chopper? haha, no.

Thats why they put a big sign that says not responsible for any damage caused by carts...it covers their *** i've seen it happen countless times.
